1. Acceptance of Terms

By accessing or using the Linklulu platform (the "Service") operated by Inagiffy Solutions Pvt. Ltd. ("Linklulu," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Linklulu is a SaaS platform that gamifies LinkedIn engagement for teams. The Service includes features such as:

  • AI-powered LinkedIn content generation and suggestions.
  • Team leaderboards, challenges, and gamification mechanics.
  • LinkedIn engagement tracking and analytics.
  • Points, achievements, and streak tracking.
  • Team management and collaboration tools.

3. Account Registration

  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized access to your account.
  • You must be at least 18 years old to create an account and use the Service.

4. LinkedIn Integration and Data

The Service integrates with LinkedIn through the LinkedIn Marketing API Program. Our use of LinkedIn data is governed by the LinkedIn Marketing API Terms. By connecting your LinkedIn account:

  • You authorize us to access your LinkedIn profile and post data through LinkedIn's OAuth 2.0 authentication flow, as described in our Privacy Policy.
  • You consent to the storage of your authenticated LinkedIn profile data for the duration of your account.
  • You agree to comply with LinkedIn's User Agreement at all times.
  • You understand that LinkedIn may change its API or terms, which could affect Service functionality.
  • You may disconnect your LinkedIn account at any time through the Service settings or your LinkedIn account settings.

4.1 LinkedIn Data Restrictions

You acknowledge and agree to the following restrictions regarding LinkedIn data accessed through the Service:

  • LinkedIn member data is displayed only within the Service and cannot be exported, downloaded, transferred, or distributed outside of the application.
  • LinkedIn member data must not be combined with any other data sources to create, supplement, or verify user profiles, leads, or databases.
  • LinkedIn member data must not be used for advertising, sales, recruiting, lead generation, ad targeting, account-based marketing, or sending mass messages.
  • LinkedIn member data obtained for managing a specific LinkedIn profile or page may only be viewed by individuals associated with that profile or page within your organization.
  • Members' social activity data (posts, comments, reactions) is retained for a maximum of 48 hours in accordance with LinkedIn's Data Storage Requirements.
  • Non-authenticated members' profile data is cached for a maximum of 24 hours and is not permanently stored.

5. AI-Generated Content

The Service uses artificial intelligence to generate LinkedIn post suggestions. Regarding AI-generated content:

  • You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing it on LinkedIn or any other platform.
  • We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content.
  • You retain ownership of content you create using the Service, including AI-assisted content.
  • You grant us a limited license to use your content solely for the purpose of providing and improving the Service.
  • You must not use AI-generated content to spread misinformation, spam, or content that violates applicable laws or LinkedIn's policies.

6. Subscriptions and Payments

  • Access to certain features requires a paid subscription plan.
  • Subscription fees are billed in advance on a recurring basis (monthly or annually) as specified at the time of purchase.
  • All payments are processed through our payment provider (DodoPayments). By subscribing, you agree to their terms of service.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • Refunds are handled on a case-by-case basis at our discretion.

7. Teams and Organizations

  • Organization administrators are responsible for managing team members, including inviting and removing users.
  • Organization data (leaderboards, challenge results, aggregate engagement metrics) is visible to all members of the organization.
  • LinkedIn member data is only visible to individuals associated with the relevant LinkedIn profile or page, in compliance with LinkedIn's limited audience requirements.
  • Organization administrators may configure point values, challenge rules, and other settings that affect all team members.
  • When a team member is removed from an organization, their individual account remains active but they lose access to organization-specific data. LinkedIn data associated with the organization is deleted within 10 days.

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the Service or its infrastructure.
  • Create multiple accounts to circumvent usage limits or restrictions.
  • Use automated scripts or bots to interact with the Service (except through our authorized APIs).
  • Share your account credentials with unauthorized third parties.
  • Use the Service to engage in LinkedIn spam, manipulation, or activities that violate LinkedIn's terms or policies.
  • Export, scrape, or extract LinkedIn member data from the Service for use outside the application.
  • Use LinkedIn data obtained through the Service for advertising, sales, recruiting, or any purpose other than managing your LinkedIn presence through the Service.
  • Create fake LinkedIn profiles or use headless accounts to manage activity through the Service.
  • Upload or transmit malicious code, viruses, or harmful content.

9. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is the exclusive property of Inagiffy Solutions Pvt. Ltd. and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

You retain all rights to the content you create and submit through the Service, subject to the limited license granted in Section 5.

LinkedIn, the LinkedIn logo, and all LinkedIn-related marks are trademarks of LinkedIn Corporation. Our use of LinkedIn data is authorized through the LinkedIn Marketing API Program and does not imply any endorsement, affiliation, or sponsorship by LinkedIn.

10. Data Deletion and Account Termination

  • You may request deletion of your account and all associated data at any time by contacting us or through the account settings.
  • Upon account deletion, all stored LinkedIn member data is permanently deleted within 10 days.
  • Upon disconnecting your LinkedIn account, we will stop collecting new LinkedIn data and delete previously stored LinkedIn member data in accordance with LinkedIn's Data Storage Requirements.
  • We may suspend or terminate your account if you violate these Terms, the LinkedIn Marketing API Terms, or engage in conduct that we determine is harmful to the Service or other users.
  • Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content generated by AI will be accurate, complete, or suitable for your purposes. We do not guarantee the continued availability of LinkedIn API access or any specific level of LinkedIn data.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKLULU INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Inagiffy Solutions Pvt. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights (including LinkedIn's terms and policies).

14. General Provisions

  • Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
  • Dispute Resolution: Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Linklulu regarding the Service.
  • Modifications: We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Continued use of the Service constitutes acceptance of the updated Terms.
  • LinkedIn API Changes: LinkedIn may modify, suspend, or discontinue its APIs at any time. We are not liable for any changes to Service functionality resulting from changes to LinkedIn's APIs, terms, or policies.
